Stake.us legal states: where it is available in 2026
People search for "Stake.us legal states," but the operator's list answers a narrower question: where Stake.us allows accounts and play. An operator restriction is not a legal opinion about every type of sweepstakes promotion in that state. Stake can also exclude a state for compliance or business reasons.

Why do some Stake.us state lists disagree?
Stake.us's restricted-states help article lists Indiana and Maine as restricted. The Excluded Territories section of the published terms currently omits those two states. We use the stricter help-center list and treat both Indiana and Maine as unavailable.
Older reviews may still say Stake.us is available in 33 states. That figure came from an earlier 17-state exclusion list and is no longer current.
Is Stake.us available in Massachusetts?
Massachusetts does not appear on either of Stake.us's current restricted-state lists, so the operator presently allows Massachusetts residents to use the platform. That is an availability statement, not a legal opinion. Massachusetts has broad gambling and sweepstakes rules, and a pending internet-gaming proposal includes an explicit ban on dual-currency online sweepstakes games.
The proposal, House Bill 4431, was sent to a study order on March 23, 2026. It has not become law. Massachusetts residents should recheck Stake.us's terms before registering or redeeming affiliate earnings because access could change if the operator adds the state to its excluded list.
California is not an eligible Stake.us state
California appears in Stake.us's current restricted-state list. The state also enacted AB 831 in October 2025. The law prohibits operating covered dual-currency online sweepstakes games in California and prohibits knowing promotion or support by media affiliates.
That is why this site does not place a Stake.us signup link on its California guide. California readers should not try to bypass geolocation or use an address from another state.
Can you play while traveling?
Stake.us's terms say customers must not live in or access the platform from an excluded territory. Being registered in an eligible state does not give you permission to play while physically located in a restricted state.
Do not use a VPN or provide inaccurate location information. Stake.us's terms prohibit attempts to mask or manipulate a customer's real location.
Age and account requirements
Stake.us currently requires customers to be at least 21 years old, or older if local law sets a higher age. Registration requires a legal name, date of birth, permanent address, email address, identification, and proof of address.
Availability can still depend on your exact location and the operator's verification checks. A state appearing in the available list does not guarantee that every registration will be accepted.
